EU Digital Services Act Notice

This notice explains how Naughty Games (naughty.games), operated by Vedia Games, meets its obligations under Regulation (EU) 2022/2065, the Digital Services Act (DSA).

Who we are and what kind of service this is

Vedia Games is established in Slovenia, in the European Union. naughty.games is an intermediary service that provides hosting within the meaning of the DSA: we store information provided by users of the service, namely game submissions, corrections, comments, and other community contributions, and we make some of it available to the public. We are a micro enterprise, so certain obligations that the DSA places on larger providers do not apply to us; the reporting and complaint routes described below are open to everyone regardless.

We do not act as an online marketplace and we do not sell goods or services to consumers.

The same address serves both. We do not require a legal representative under Article 13 because we are established in the Union. Electronic communication to the address above is our preferred and monitored channel; postal correspondence is available on request.

Reporting illegal content

Anyone can report content on naughty.games that they consider illegal. Send the report to [email protected], or use the report link on the page itself where one is offered. To let us act on it (Article 16), please include:

  • A sufficiently substantiated explanation of why you consider the content illegal.
  • The exact URL of the page, and, where a page holds several items, which item you mean.
  • Your name and email address, unless the report concerns an offence under Articles 3 to 7 of Directive 2011/93/EU, in which case you may report anonymously.
  • A statement that you believe, in good faith, that the information in the report is accurate and complete.

We confirm receipt without undue delay, decide in a timely, diligent, non-arbitrary, and objective way, and tell you the outcome.

For copyright complaints, use the DMCA notice and takedown policy instead; it is the faster route for that specific case.

How we moderate

Content submitted to the site is reviewed with a combination of automated tools and human review. Automated systems screen comments and messages for material that breaks our rules or the law; anything that the automated screen flags, and anything reported to us, is looked at by a person before a final decision is made. Purely automated decisions are limited to holding content back for that review.

Statement of reasons

When we remove content, restrict its visibility, or suspend an account, we tell the affected user what we did, what the legal or terms-of-service ground was, whether automated tools were involved, and how to challenge the decision (Article 17), unless we are legally barred from doing so or we have no way of contacting them.

Complaining about a decision

If you disagree with a decision we made, whether that is removing your content, refusing to act on your report, or suspending your account, email [email protected] with DSA complaint in the subject and tell us which decision you mean. We handle complaints for at least six months after the decision, we review them with human oversight rather than by automated means alone, and we reverse the decision where the complaint is well founded.

If you are not satisfied with the outcome, you may:

  • Refer the dispute to a certified out-of-court dispute settlement body under Article 21, which we will engage with in good faith.
  • Lodge a complaint with the Digital Services Coordinator of the Member State where you are established or located.
  • Seek judicial redress before the competent courts.

Misuse

Under Article 23 we may suspend, after a warning, users who frequently post manifestly illegal content, and the handling of reports from notifiers who frequently submit manifestly unfounded reports. We judge this case by case, taking into account the numbers involved, their proportion of the total, and the gravity of the misuse.

Advertising

naughty.games is an 18+ site and is not directed at minors. We do not present advertising based on profiling that uses special categories of personal data, and we do not knowingly present advertising to minors. Advertising slots on the site are filled by third-party advertising networks; individual creatives are selected by those networks and are labelled as advertising where they appear.

Orders from authorities

Orders to act against illegal content (Article 9) and orders to provide information (Article 10) should be sent to [email protected]. We act on them in accordance with the DSA and inform the recipient of the service concerned, and the issuing authority of the effect given to the order, as required.
